Welcome to Sales or Else LLC ("Company," "we," "our," "us"), doing business as Caples.ai. We are committed to protecting your personal information and your right to privacy. If you have any questions or concerns about this privacy notice or our practices regarding your personal information, please contact us at hello@caples.ai.

When you visit our website at www.caples.ai (the "Website") and use our AI-powered advertising services (the "Services"), you trust us with your personal information and your proprietary creative and advertising data. We take your privacy seriously. This privacy notice describes what information we collect, how we use it, who we share it with, and what rights you have in relation to it.

This Privacy Policy should be read together with our Terms of Service, available at caples.ai/terms-of-service. If there are any terms in this Privacy Policy that you do not agree with, please discontinue use of our Services.

2. Information We Collect

We collect information that you voluntarily provide to us when you register for the Services, connect third-party accounts, use the platform's features, or contact us. The information we collect falls into the following categories:

A. Account Information

  • Personal Details: Name, email address, and contact preferences.
  • Billing Data: We use a third-party payment processor to handle payments. We store customer and subscription identifiers for billing management. We do not store credit card numbers, expiration dates, or CVV codes on our servers.
  • Authentication Data: If you sign in via Google OAuth, we receive your name and email address from Google to facilitate the login process.

B. AI Service Data (Inputs & Outputs)

  • User Inputs: Text, prompts, images, videos, ad account information, knowledge base data, and guardrails you input into the Services ("Input").
  • AI Outputs: Text, images, videos, reports, briefs, scripts, and any other content generated and returned by the Services ("Output"). We store Output to provide you with generation history and session continuity.
  • Knowledge Base Data: Ad Account information, creative strategy data, media buying targets (budget, CAC, ROAS goals), and sales page offer details you provide during onboarding or edit within the knowledge base.

C. Meta Ads Data

When you connect your Meta (Facebook/Instagram) advertising account to the Services, we collect:

  • OAuth Access Tokens: Used to authenticate API requests to Meta on your behalf. These tokens are encrypted at the application level before storage.
  • Ad Account Information: Account ID, account name, and connected page information.
  • Campaign Performance Data: Campaign, ad set, and ad-level metrics including spend, impressions, clicks, conversions, cost per result, ROAS, and other performance indicators retrieved via the Meta Graph API.
  • Ad Creative Data: Ad copy, headlines, descriptions, and creative format information for performance analysis.
  • Cached Data: We cache Meta Ads API responses to generate daily reports and avoid excessive API calls. Cached data is purged when you disconnect your Meta account or delete your Caples.ai account.

We access your Meta Ads account in read-only mode unless you have explicitly enabled write-access features (such as Apply Actions), in which case each action requires your individual approval before execution. We never access your Meta account password — authentication is entirely token-based via OAuth.

D. Usage & Analytics Data

  • Usage Logs: Generation frequency, feature usage, timestamps, and Creative Token consumption. Used to enforce our Fair Use Policy and rate limits.
  • Product Analytics: We collect anonymized product analytics including page views, feature adoption, browser type, and device information.
  • Error Monitoring: We use error monitoring tools that capture error metadata for debugging. These tools do not capture user-generated content.

E. Information We Do NOT Collect

  • Meta account passwords (authentication is token-based via OAuth)
  • Credit card numbers or payment card details (handled entirely by Stripe)
  • Data from ad accounts you have not explicitly connected
  • Browsing data from other websites

3. How We Use Your Information

We use the information we collect for the following purposes:

  • To Provide the Services: We process your Input to generate Output. This involves transmitting your Input to our AI providers (see Section 4). We use your Meta Ads data to generate daily performance reports and recommendations. We use your Knowledge Base data to personalize AI-generated content to your ad account.
  • To Manage Your Account: To create and maintain your account, process payments, send invoices, manage your subscription, and communicate updates to our terms or policies.
  • To Send Transactional Communications: We use your email address to send operationally necessary notifications including daily report alerts, password resets, security notices, and account verification emails. We do not send marketing emails or newsletters without your separate, explicit consent.
  • To Protect Our Platform: We analyze usage logs and rate limiting data to detect automated bots, scrapers, and abuse of our Fair Use Policy.
  • To Improve the Services: We may use aggregated, anonymized data derived from platform usage patterns to improve the Services, identify bugs, and optimize performance. This aggregated data cannot be used to identify any individual user.

No AI Model Training on Individual User Data: We do not use your individual Input or Output to train AI models.

4. How We Share Your Information

We do not sell your personal information. We do not share your data with third parties for their marketing purposes. We share your information only with the service providers necessary to operate the Services, as described below.

AI Sub-Processors

To provide the Services, we transmit your Input and related data to third-party AI providers for processing. Each provider processes data solely to generate Output and return it to you. Our current AI sub-processors include Anthropic, Google, Perplexity, OpenAI, and others. We may add, remove, or replace AI sub-processors as the Services evolve.

Infrastructure & Service Providers

We use third-party vendors to host, operate, and support the Services. These include providers for database and authentication, application hosting, cloud compute, payment processing, email delivery, error monitoring, and rate limiting. Key infrastructure providers include Supabase, Vercel, AWS, and Stripe. A complete list of sub-processors is available upon request by emailing hello@caples.ai.

Legal & Business Disclosures

  • Compliance with Laws: We may disclose your information where legally required (e.g., in response to a court order, subpoena, or valid legal process).
  • Business Transfers: We may share or transfer your information in connection with any merger, sale of company assets, financing, or acquisition of all or a portion of our business to another company.
  • Safety & Fraud Prevention: We may disclose information if we believe disclosure is necessary to protect the rights, property, or safety of Caples.ai, our users, or the public.

5. Data Security

We have implemented technical and organizational security measures designed to protect your information:

  • Encryption in Transit: TLS/SSL encryption on all traffic.
  • Encryption at Rest: AES-256 encryption on stored data.
  • Application-Level Encryption: Advertising platform credentials are encrypted at the application level before storage.
  • Authentication: Server-side token verification on all API routes.
  • Infrastructure: Hosted on SOC2-certified infrastructure. Caples.ai itself is not SOC2 certified — our infrastructure providers are.

Internal Data Access

Authorized personnel may access user data for essential operations including debugging, customer support, and infrastructure maintenance. No team member accesses your Meta ad account directly — all interaction is through the platform.

Limitations

No method of electronic transmission or storage is 100% secure. While we implement commercially reasonable security measures, we cannot guarantee absolute security. Transmission of personal information to and from our Services is at your own risk.

6. Data Retention

Account Data

We retain your personal information for as long as your account is active.

AI Service Data

We retain your Input, Output, knowledge base data, chat history, and generated assets (images, videos) for as long as your account is active to provide you with generation history and session continuity. You may delete specific sessions or assets within the application interface at any time.

Meta Ads Data

Cached Meta Ads API data is retained for report generation purposes. Cached data is purged when you disconnect your Meta account or delete your Caples.ai account.

Account Deletion

You may request full account deletion at any time by emailing hello@caples.ai. Upon deletion, we remove your user record, knowledge base, chat history, generated assets, advertising platform integration data, and cancel your subscription. Deletion is completed within thirty (30) days of your request, unless a longer retention period is required by law (such as tax or accounting requirements).

7. Cookies & Tracking Technologies

Essential Cookies

We use essential cookies for authentication and application functionality. These cookies are strictly necessary for the Services to operate and cannot be disabled.

Analytics

We use analytics tools to collect usage data including pages visited, feature interactions, browser type, device type, and general location. These tools help us understand how users interact with the Services and improve the user experience.

Advertising & Conversion Tracking

We use the following tracking technologies on our marketing website and within the Services to measure the effectiveness of our advertising campaigns and optimize our marketing efforts:

  • Meta Pixel (Facebook Pixel): We use the Meta Pixel to track conversions from Meta ads, build targeted audiences for future ads, and remarket to people who have taken actions on our website. The Meta Pixel collects data such as pages visited, actions taken (e.g., registration, trial start), browser and device information, and IP address. This data is shared with Meta and subject to Meta's Data Policy.
  • Google Analytics: We use Google Analytics to analyze website traffic and usage patterns. Google Analytics collects data such as pages visited, session duration, referral source, browser type, and approximate location. This data is processed by Google in accordance with Google's Privacy Policy.
  • LinkedIn Insight Tag: We use the LinkedIn Insight Tag to track conversions from LinkedIn ads, gain insights about website visitors, and enable LinkedIn ad retargeting. The LinkedIn Insight Tag collects data such as pages visited, metadata (URL, referrer, IP address), and device and browser information. This data is shared with LinkedIn and subject to LinkedIn's Privacy Policy.

These tracking technologies use cookies and similar technologies (such as pixels and local storage) that may collect and transmit data to third-party advertising platforms. This data may be used by these platforms to serve you targeted advertising on their networks.

Managing Your Cookie Preferences

Most web browsers allow you to control cookies through their settings. You can typically choose to block or delete cookies. Please note that disabling essential cookies may affect the functionality of the Services. To opt out of interest-based advertising, you may also visit:

Do Not Track

Some browsers offer a "Do Not Track" (DNT) signal. We do not currently respond to DNT signals, as there is no industry-standard interpretation of this signal. We limit our use of your personal information as described in this Privacy Policy regardless of your DNT setting.

8. Your Privacy Rights

All Users

Regardless of your location, you have the right to:

  • Access: Request a copy of the personal data we hold about you.
  • Rectification: Request that we correct any inaccuracies in your personal data.
  • Deletion: Request the deletion of your personal data. See Section 6 for the deletion process.
  • Data Portability: Request a copy of your data in a structured, machine-readable format.
  • Withdraw Consent: Where we process your data based on consent, you may withdraw that consent at any time.

European Union / European Economic Area (GDPR)

If you are located in the EU or EEA:

  • Legal Basis for Processing: We process your personal data on the following legal bases:
    • Contract Performance: Processing necessary to provide the Services you have subscribed to (account management, AI generation, report delivery, Meta Ads integration).
    • Legitimate Interest: Processing necessary for our legitimate business interests (security, fraud prevention, platform improvement via aggregated analytics) where those interests are not overridden by your rights.
    • Consent: Where you have given explicit consent (e.g., connecting your Meta Ads account, optional marketing communications).
  • International Data Transfers: Your data is stored and processed in the United States. By using the Services, you consent to the transfer of your data to the United States. We rely on Standard Contractual Clauses (SCCs) where applicable to provide appropriate safeguards for international transfers.
  • Right to Lodge a Complaint: You have the right to lodge a complaint with your local data protection supervisory authority if you believe your rights have been violated.

California (CCPA/CPRA)

If you are a California resident:

  • We Do Not Sell Personal Information. We have not sold personal information in the preceding twelve (12) months and do not intend to sell personal information.
  • Sharing for Advertising. We use tracking technologies (such as the Meta Pixel, Google Analytics, and LinkedIn Insight Tag) that may constitute "sharing" of personal information for cross-context behavioral advertising under the CCPA/CPRA. You may manage your preferences through your browser settings or the third-party opt-out links listed in Section 7.
  • Right to Know: You have the right to request disclosure of the categories and specific pieces of personal information we have collected about you.
  • Right to Delete: You have the right to request deletion of your personal information, subject to certain exceptions.
  • Right to Non-Discrimination: We will not discriminate against you for exercising your privacy rights.

Exercising Your Rights

To exercise any of the rights described above, please contact us at hello@caples.ai. We may need to verify your identity before processing your request. We will respond to verified requests within thirty (30) days, or within the timeframe required by applicable law.

9. Children's Privacy

The Services are not directed to individuals under the age of 18. We do not knowingly collect personal information from children under 18. If we become aware that a child under 18 has provided us with personal information, we will take steps to delete that information. 10. Third-Party Links

The Services may contain links to third-party websites or services that are not operated by us. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party websites or services. We encourage you to review the privacy policy of every site you visit.

11. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. The updated version will be indicated by a revised "Last Updated" date at the top of this page. If we make material changes to how we collect, use, or share your personal information, we will notify you via email to the address associated with your account and/or via a prominent notice within the Services at least thirty (30) days before the changes take effect. Your continued use of the Services after the effective date of any changes constitutes your acceptance of the updated Privacy Policy.
